Detaljeret og praktisk gennemgang af ny ferielov

En ny ferielov er på vej. Folketinget har vedtaget en ny ferielov, hvor der indføres samtidighedsferie, hvor ferien optjenes og afholdes løbende. Det betyder en grundlæggende ændring af måden vi optjener og afholder ferie.

 

Den nye ferielov er først fuldt ud implementeret 1. september 2020. For medarbejdere, der er på arbejdsmarkedet, før overgangen til samtidighedsferie, har det været nødvendigt at indføre en overgangsordning. Det betyder, at optjente feriepenge fra 1. september 2019 til 31. august 2020 indfryses og først må udbetales til medarbejderne, når de forlader arbejdsmarkedet.

Hej - kommer der et kursus hvor man tager hensyn til brug af MLE (Visma løn) i forhold til den  nye ferielov? Så vidt jeg kan se, omhandler dette alene loven, eller tager jeg fejl?

Tak for dit spørgsmål. Det er korrekt at vores ferielovskurser pt. er koncentreret om lovgivningen. Vi afventer i øjeblikket afklaring på, i hvilket omfang generelle og/eller lokale aftaler om feriefridage og omsorgsdage mv. skal tilpasses de nye regler på ferieområdet. I Visma følger vi spændt dialogen og aftaler om de kollektive overenskomster samt udviklingen på arbejdsmarkedet i øvrigt, da udfald af beslutninger vil påvirke en stor del af vores kunder. Hertil vil beslutningerne påvirke den nye funktionalitet, som vores lønsystemer skal kunne håndtere.

Please help me on New Holiday Act.

 

What would be new holiday year?

As soon as I earn holiday, I can utilized that in the same year. Is this correct??

Will my balance holiday would be carryforward to new year? If yes how many leaves would be carry forward?

Thank you for your mail, happy to hear you appreciate our updates.

 

The new Holiday Act is not enforced yet, though it has been approved by Danish Parliament (Folketinget). 

The new rules enter into force on 1 September 2020.

 

What remains still are local labour market parties’ agreements on how to manage the Act.

 

With the new Act, the employee will earn and utilise his holiday at the same time over a period of 12 months (holiday year). This means that holiday earned in February can be utilised already in March same year. The employee, though, has the option to ultilize the earned holiday for additionally 4 months which gives 16 months to utilise the holidays.

 

I cannot give you exact guidance on the carry forward yet, since this will depend on local agreements still to be agreed. 

 

We will keep our customers informed about the agreements and how our systems will help balance and calculate according to the new rules!

Could you please assist me for Holiday Base calculation with below example.

Example:

One of our employee has 50.000,00 Dkk Holiday Base salary.

He has 25 leaves in his account earned from last year  i.e 2016.

What if he takes 2 leaves.?

Will his Holiday Base (basis) salary will remain  50.000,00 DKK

OR

will deduct  (4.8% of 50.000,00) * 2  DKK  from Holiday Base salary

You have not explicitly outlined the necessary pieces of information needed to give you correct guidance on the calculation, i.e.:
- did the employee earn the full 25 Leave Days at your company, or was it split between multiple employers?
- what was paid in "Ferietillæg" (Danish Holiday bonus)?
- what is the employee's tax rate?

We are still waiting him to get back to us.

We got hard rejection from SKAT for eIndkomst for feb-2018 month for 2 of our associate.We are not aware why that happened ? how to rectify it.?
